Federal Court Rejects Trump Administration's Claim That Courts Have No Power to Review Deportation of Iraqis

DETROIT – Last night, Judge Goldsmith ruled federal courts have jurisdiction to delay deportations of Iraqi nationals during a review of removal orders. 

“A huge sigh of relief was heard throughout the Iraqi-American community last night,” said Michael J. Steinberg, legal director of the ACLU of Michigan. “As the judge recognized, immediate deportation is the equivalent of a death sentence for some Iraqi nationals. The judge’s ruling will provide more time for Iraqi nationals to prove to immigration court judges that they would be persecuted, tortured or killed if sent to Iraq.”

Update: On June 24, the ACLU of Michigan filed an amended complaint to turn the Michigan case into a nationwide class action on behalf of all Iraqi nationals who face deportation. Additionally, The ACLU of Michigan filed a motion asking the judge to extend his order nationwide in order to ensure that ICE does not deport individuals who will face persecution, torture or death in Iraq.

The ACLU filed a class-action lawsuit today to immediately stop federal immigration officials from deporting more than 100 Iraqi nationals rounded up in raids by federal agents last weekend, arguing that it is illegal to deport the detainees without giving them an opportunity to prove that they could face torture and even death if returned to Iraq.
