Student Rights

Constitutional violations are far too common in public schools across the country. Teachers and administrators have a responsibility to provide a safe environment for the students that is conducive to learning. They also have a responsibility to respect each student's individual rights. These two missions are not incompatible. Simply put, students have rights too.

WASHINGTON, DC—The U.S. Supreme Court announced today that it will hear the case of Ehlena Fry, a 12-year-old Jackson, Mich., girl with cerebral palsy who, at age 5, was banned from bringing her service dog to class. At the heart of the appeal is whether students in certain circumstances can bring claims under the Americans with Disabilities Act without first exhausting administrative processes under a separate law.

If, as expected, the Detroit Public Schools legislation recently passed by the Michigan House and Senate is signed into law by Gov. Rick Snyder, the hijacking of democracy that has been underway since the district was taken over by the state in 2009 will continue with no foreseeable end in sight.

Some might claim that can't be true, pointing to the fact that the new law allows Detroiters to vote for a new school board.

In 2014, the ACLU of Michigan received several complaints that the graduation ceremony at a public high school in Zeeland featured Christian prayers approved by school officials. We wrote a letter to the superintendent and principal explaining that the constitutional prohibition on school-sponsored prayer at graduation is a vital safeguard of individual religious freedom. In February 2015, the school district informed us that prayer during the graduation ceremony would be discontinued.
